Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-Off Period: The period during which the consumer may exercise their right of withdrawal.
Consumer: Any natural person not acting in the course of a business or profession who enters into a distance contract with the merchant.
Day: Calendar day.
Recurring Contract: A distance contract relating to a series of products and/or services for which the delivery obligations occur over time.
Durable Data Carrier: Any tool that enables the consumer or merchant to store information in a way that allows future consultation and unaltered reproduction.
Right of Withdrawal: The consumer’s ability to cancel a distance contract within the cooling-off period.
Merchant: The natural or legal person offering products and/or services to consumers at a distance.
Distance Contract: A contract concluded using one or more methods of distance communication, as part of a system organized by the merchant for remote sales.
Distance Communication Technology: Any tool enabling the conclusion of a contract without the consumer and merchant being in the same location simultaneously.
Terms & Conditions: These Terms & Conditions of the merchant.


Article 2 – Applicability

These Terms & Conditions apply to every offer by the merchant and every distance contract concluded between the merchant and the consumer.

Before a distance contract is finalized, the consumer will receive access to these Terms & Conditions. If this is not reasonably possible, the merchant will inform the consumer where the terms can be viewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, the Terms & Conditions may be provided digitally in a way that allows the consumer to easily save them on a durable data carrier.

If, in addition to these Terms, specific product or service conditions apply, the consumer may rely on whichever provision is most favorable to them in case of conflict.

If any provision becomes void or invalid, the remaining provisions remain fully effective. The invalid provision will be replaced with one that matches the original intent as closely as possible.

Any ambiguity regarding these Terms shall be interpreted “in the spirit” of the Terms.


Article 3 – The Offer

If an offer has a limited validity period or special conditions, this will be clearly stated.

All offers are non-binding; the merchant may modify or update them at any time.

Product descriptions are complete and accurate enough for the consumer to assess the offer properly. Images represent the products truthfully but may vary slightly in color due to screen differences.

Obvious errors or mistakes in the offer do not bind the merchant.

Each offer includes information about:

– The price (excluding import duties and import VAT; these are the responsibility of the customer).
– Shipping costs.
– How the contract is created.
– Whether the right of withdrawal applies.
– Payment, delivery, and fulfillment methods.
– The validity of the offer's price.
– Whether the contract will be archived.
– How the consumer can review and correct information before placing an order.
– Available languages.
– Applicable codes of conduct.
– The duration in case of a recurring contract.
– Optional features such as available sizes, colors, and materials.


Article 4 – The Contract

The contract is formed when the consumer accepts the offer and complies with the applicable conditions.

If acceptance occurs electronically, the merchant will confirm receipt electronically. Until this confirmation is received, the consumer may cancel the contract.

The merchant takes appropriate security measures for electronic data transfer and ensures a secure web environment.

The merchant may assess whether the consumer can meet their payment obligations. If there are legitimate grounds to refuse, the merchant may decline an order or apply special conditions.

The merchant will provide the consumer with:
– Contact details for complaints.
– Information about the right of withdrawal or its exclusion.
– Warranty information.
– Any previously undisclosed details required for contract execution.
– Terms for canceling long-term agreements.

For recurring deliveries, these apply only to the first shipment.

All contracts are subject to product availability.


Article 5 – Right of Withdrawal

The consumer may cancel a purchase within 14 days without stating a reason. The cooling-off period begins the day after receiving the product.

The consumer must handle the product and packaging carefully during this period and may only use it to the extent needed to assess it.

To exercise the withdrawal right, the consumer must notify the merchant via written message/email within 14 days of receiving the product. After notification, the product must be returned within 14 days.

If the consumer does not notify withdrawal within the stated terms or does not return the product on time, the purchase becomes final.


Article 6 – Costs of Withdrawal

Return shipping costs are the responsibility of the consumer.

If the consumer has already paid, the merchant will refund the amount within 14 days after withdrawal, provided the returned product has been received or proof of return has been supplied.


Article 7 – Exclusion of Withdrawal Right

The merchant may exclude the right of withdrawal for products that:
– Are made according to consumer specifications.
– Are clearly personal in nature.
– Cannot be returned due to their nature.
– Deteriorate quickly.
– Are subject to financial market fluctuations.
– Consist of newspapers or magazines.
– Contain sealed audio/video/software that has been opened.
– Are sealed hygienic products whose seal has been broken.

The right of withdrawal may be excluded for services involving:
– Accommodation, transport, restaurant or leisure services with a fixed date.
– Services begun with the consumer’s explicit consent before the cooling-off period.
– Betting or lottery services.


Article 8 – Prices

Prices will not increase during the offer period, except for VAT changes.

Products influenced by financial market fluctuations may have variable pricing; this will be stated in the offer.

Price increases within 3 months of contract formation are allowed only due to legal changes.

Delivery occurs outside the EU; therefore, import VAT and clearance fees may be charged by the delivery courier to the recipient.

The merchant is not liable for typographical errors; incorrect pricing does not obligate delivery.

Article 10 – Conformity & Warranty

Products must meet reasonable expectations of quality and match the description provided.

Defects must be reported within 14 days of delivery.

Warranty equals the manufacturer's warranty. The merchant is not responsible for suitability for individual use cases.

Warranty does not apply if:
– The consumer has repaired/modified the product.
– The product was misused or handled contrary to instructions.
– Government regulations affect materials or product quality.


Article 11 – Delivery & Execution

Orders are handled with the highest possible care.

Delivery occurs at the address provided by the consumer.

Orders are fulfilled within 30 days, unless a longer timeframe is accepted by the consumer.

If delays occur or a product cannot be delivered, the consumer will be notified within 30 days and may cancel the contract for a full refund.

If a product is unavailable, the merchant may provide a substitute product. The right of withdrawal still applies, and return shipping in this case is free for the consumer.

The merchant bears the risk of damage or loss until delivery to the consumer.


Article 12 – Recurring Contracts: Duration, Termination & Renewal

Consumers may cancel contracts of indefinite duration with a notice period of up to one month.

Contracts of fixed duration may be cancelled at the end of the term with up to one month’s notice.

Automatic renewals for set periods are not allowed except under special cases for newspapers and magazines (max 3 months).

Trial subscriptions end automatically unless otherwise stated.

Contracts lasting more than one year may be terminated after one year with up to one month’s notice.


Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 business days of the start of the cooling-off period.

Consumers must report incorrect billing information immediately.

In case of non-payment, reasonable collection costs may be charged.


Article 14 – Complaints

Complaints must be submitted within 7 days after the consumer identifies an issue.

The merchant responds within 14 days. If more time is needed, the consumer will be informed with an estimated response time.

A complaint does not suspend the consumer’s payment obligations unless agreed otherwise.

If the complaint is justified, the merchant will repair or replace the product at no cost.


Article 15 – Disputes

These Terms & Conditions and all agreements between LouisHarper and consumers are governed exclusively by Dutch law, even if the consumer resides abroad.


Article 16 – CESOP

Due to EU CESOP regulations effective from 2024, payment service providers may register data in the European CESOP system as required by law.
